General Information

Sweepstakes Name: Epic Wings Rancho Cucamonga Epic Meal (“Sweepstakes”). 

Sponsor/Administrator: Epic Wings 12075 Carmel Mountain Road #201 San Diego, CA 92128 (“Sponsor” or “Administrator”).

Timing/Registration Period: Sweepstake’s registration begins at 11:59:59 pm Pacific Time (“P.T.”) on 11/1/2023 and ends at 11:59:59 pm P.T. on 11/15/2023 (“Registration Period”). 

The Sweepstakes computer is the official time keeping device for the Sweepstakes. The Sweepstakes is subject to all applicable federal, state, and local laws and regulations. Void outside California and wherever prohibited by law. 

Official Rules & Winner List: For a copy of these Official Rules or the names of prize winner, send a self-addressed stamped envelope to Epic Wings 12075 Carmel Mountain Rd. Ste. 201 San Diego, CA 92128. PLEASE SPECIFY your request: official rules or winner list. 

Odds: Odds of being selected as Grand Prize Winner depend on the number of eligible entries received.

Eligibility: Sweepstakes is open only to individuals who are legal residents of and physically located within California, age 18 or older at the date of entry, and have a valid U.S. driver’s license or government-issued I.D.

The following are not eligible to enter or win: employees, officers, managers, directors, and owners of (a) Sacco Restaurants, Inc. or any Epic Wings Restaurant or Epic Wings franchisee; (b) any parent entity, affiliated entity or subsidiary of any of the foregoing; or (c) distributors, retailers, printers, advertising and promotion agencies, and any other service provider to any of the foregoing; or (d) any company associated with the design or execution of the Sweepstakes (collectively, “Released Parties”). Also not eligible are immediate families or households, whether or not related, of the above. Immediate families mean parents, step-parents, parents-in-law, step-parents-in-law, grandparents, siblings, step-siblings, children, step-children, grandchildren, step-grandchildren, and respective spouses, regardless of where they reside. 

How to Enter

Online: Entries must be made on Instagram. To enter the Sweepstakes, entrants must follow the below steps. 

Step 1: Entrant must follow the Rancho Cucamonga Instagram account @epic.wings.rancho

             and comment on any post made between 11/1/23 -11/15/23.

Step 2: Entrant must follow the Epic Wings Brand Instagram account @officialepicwings. 

             and comment on any post made between 11/1/23 – 11/15/23.

Entries: Entries will be put into a random generator to pull one (1) Grand Prize winner.

Limit on Number of Entries: Only one entry is allowed per person with an Instagram account.

Agreement to These Rules: By registering to enter the Sweepstakes, you affirm that you read and accepted these Official Rules. You agree to be bound by and abide by these Official Rules. 

Illegible Entry: Any incomplete or illegible entry or entry submitted with an invalid or false Instagram, email address, or phone number will be disqualified. 

Non-Responsibility: Released Parties are not responsible for lost, late, misdirected, illegible, incomplete, invalid, unintelligible or damaged entry, or any entry submitted in a manner not allowed under these Official Rules, or for any entry not submitted or received due to technical error or failure, unauthorized human intervention, inaccurate capture or mis-entry of any information, or failure to capture any information for any reason, also including programming or technical error, or effects of hackers or failure of electronic equipment, computer or cellular transmissions or network connections. Any available opt-in opportunities are not required to enter the Sweepstakes, and checking opt-in boxes will not improve your chances of winning. 

All entries become the property of Sponsor and will not be returned. Information submitted to Sponsor in the Sweepstakes will be treated according to Sponsor’s privacy statement, available at https://www.epicwingsnthings.com/privacy-policy/

Each entrant must submit an entry on their behalf. An entry submitted on behalf of another individual or, using another person’s Instagram or email account or providing a false Instagram, email address or other information will be disqualified and ineligible for any prize. 

Any attempt by an entrant to obtain more than the stated number of entries allowed by using duplicate, multiple/different Instagram accounts, emails, identities, or other method(s) voids all of that entrant’s entries and that entrant may be disqualified. Mechanically reproduced or automated entry is not permitted. Using any automated system to participate is prohibited and will result in disqualification, and all such entries will be deemed void. 

In a dispute as to any online registration, the authorized account holder of the email address used to register will be deemed to be the registrant. That individual must be eligible according to these Official Rules to qualify for a prize. The authorized email account holder is the natural person assigned an email address by an Internet access provider, online service provider, or other organization responsible for assigning email addresses for the domain associated with the submitted address. 

Grand Prize Information

Grand Prize: A maximum of one (1) Grand Prize Award available.

Grand Prize Award: consists of ten (10) Free Single Meal Coupons. Valid through 2/29/24.

Grand Prize Value: Total value of the prize is $129.50.

Total Value of Sweepstakes: $129.50

Redemption Location: In-Store Only at Epic Wings 10877 Foothill Blvd. Rancho Cucamonga, CA 91730. 

Additional Rules & Restrictions: An entrant who wins a prize and is later found to be in violation of these Official Rules will be required to forfeit the prize or reimburse the Sponsor for the stated value of the award if a violation is discovered after the winner used the prize. Participation in the Sweepstakes constitutes permission for the Sponsor and its designees to use the entrant’s name, biographic information, city, and state (California) of residence, likeness, and other personality elements and statements made for advertising and trade in all media now or hereafter known, worldwide, in perpetuity without limitation or further compensation, notification, or permission, unless prohibited by law. A false, fraudulent, or deceptive entry or act shall render the entrant ineligible for any prize. 

Winner Selection & Notification: On or about 11/27/23, a random drawing will be held from all eligible entries received to select one (1) potential Grand Prize Winner.  

The potential Grand Prize Winner will be notified through Instagram direct message on or about 11/27/23. If Administrator is unsuccessful in reaching the potential winner after two (2) attempts within 24 hours of the initial notification, that entrant may be disqualified, and an alternate potential Grand Prize Winner may be randomly selected from among the remaining eligible entries and notified using the procedures above.

During Grand Prize Winner notification, the selected potential Grand Prize Winner must confirm eligibility, provide an email, phone number and address to mail coupons, and indicate willingness and ability to accept the prize. The potential Grand Prize Winner will then receive official notification via email and details of the process.

A selected winner who does not meet all eligibility requirements or is unable or unwilling to accept the prize or elects to decline the award, will be disqualified and, at Sponsor’s discretion, an alternate winner will be randomly selected from among all remaining eligible entries and notified using the procedures above. A disqualified contestant will not receive any alternate prize, substitution, or compensation. 

Judgments and decisions of the Sponsor in selecting and determining the Grand Prize Winner and all matters relating to this Sweepstakes are final and binding. 

The Grand Prize Winner will be responsible for paying all local, state, federal, and any other taxes on the prize. Failure to collect or properly claim any prize in accordance with these rules will result in forfeiture of the prize. If forfeited for any reason, the entrant will not receive any other prize, substitution, or compensation, and the prize will not be awarded, except as provided herein. 

BY PARTICIPATING, ENTRANT RELEASES AND AGREES TO HOLD ALL RELEASED PARTIES, ALSO SOCIAL MEDIA OWNERS AND OPERATORS HARMLESS FROM ANY AND ALL CLAIMS, LOSSES, ACTIONS, OR DAMAGES OF ANY KIND, WHETHER ACTUAL, INCIDENTAL OR CONSEQUENTIAL, FOR INJURY (INCLUDING BUT NOT LIMITED TO DEATH), DAMAGES, LOSSES OR EXPENSES ARISING OUT OF OR RELATING TO ENTRANT’S PARTICIPATION IN THE SWEEPSTAKES, OR THE ACCEPTANCE, POSSESSION OR USE/MISUSE OF ANY PRIZE, OR PARTICIPATION IN PRIZE-RELATED ACTIVITIES, INCLUDING BUT NOT LIMITED TO TRAVEL OR ACTIVITY RELATED THERETO, AND TO ASSUME ALL LIABILITY THEREFOR. 

RELEASED PARTIES SHALL NOT BE LIABLE TO WINNER OR ANY OTHER PERSON FOR FAILURE TO SUPPLY THE PRIZE OR ANY PART THEREOF OR INABILITY OF ANY PERSON TO USE THE PRIZE IN WHOLE OR IN PART, BY REASON OF ANY ACT OF GOD, ACTIONS, REGULATIONS, ORDERS OR REQUESTS BY ANY GOVERNMENTAL ENTITY, EQUIPMENT FAILURE, TERRORIST ACT, WAR, FIRE, EARTHQUAKE, FLOOD, RAIN, SEVERE WEATHER, EMBARGO, LABOR DISPUTE OR STRIKE, LABOR OR MATERIAL SHORTAGE, TRANSPORTATION INTERRUPTION, ILLNESS, PANDEMIC OR ANY OTHER CAUSE BEYOND RELEASED PARTIES’ SOLE CONTROL. 

SPONSOR DISCLAIMS ALL LIABILITY FOR INABILITY OF AN ENTRANT TO COMPLETE OR CONTINUE AN ENTRY DUE TO EQUIPMENT MALFUNCTION, INTERNET DISRUPTIONS, BUSY LINES, INADVERTENT DISCONNECTIONS, ACTS BEYOND SPONSOR’S CONTROL, OR OTHERWISE. SPONSOR DISCLAIMS LIABILITY FOR ENTRIES NOT RECEIVED DUE TO TECHNICAL DIFFICULTY OR TRANSMISSION ERROR. SPONSOR DISCLAIMS LIABILITY FOR ANY DELAY, MIS-DELIVERY, LOSS, OR FAILURE IN THE DELIVERY OF ANY ITEM SENT BY MAIL, COURIER, ELECTRONIC TRANSMISSION, OR OTHER DELIVERY METHOD. RELEASED PARTIES ARE NOT RESPONSIBLE FOR MECHANICAL, TECHNICAL, ELECTRONIC, COMMUNICATIONS, TELEPHONE, COMPUTER, HARDWARE OR SOFTWARE ERROR, MALFUNCTION OR FAILURE OF ANY KIND, INCLUDING: FAILED, INCOMPLETE, GARBLED OR DELAYED TRANSMISSION OF ONLINE ENTRIES, TRAFFIC CONGESTION ON TELEPHONE LINES, THE INTERNET OR AT ANY WEBSITE OR LOST OR UNAVAILABLE NETWORK CONNECTIONS WHICH MAY LIMIT AN ONLINE ENTRANT’S ABILITY TO PARTICIPATE IN THE SWEEPSTAKES, AND ANY INJURY OR DAMAGE TO ENTRANT’S OR ANY OTHER PERSON’S COMPUTER OR MOBILE PHONE RELATED TO OR RESULTING FROM PARTICIPATING IN OR DOWNLOADING ANY INFORMATION NECESSARY TO PARTICIPATE IN THE SWEEPSTAKES. RELEASED PARTIES ARE NOT RESPONSIBLE FOR ANY OTHER ERRORS OF ANY KIND, WHETHER COMPUTER, TECHNICAL, TYPOGRAPHIC, PRINTING, HUMAN OR OTHERWISE, RELATING TO OR IN CONNECTION WITH THE SWEEPSTAKES, INCLUDING, WITHOUT LIMITATION, ERRORS WHICH MAY OCCUR IN CONNECTION WITH PRINTING OR ADVERTISING THIS SWEEPSTAKES, ADMINISTRATION OR EXECUTION OF THE SWEEPSTAKES, THE CANCELLATION OF THE SWEEPSTAKES, THE PROCESSING OF ENTRIES OR IN THE ANNOUNCEMENT OF THE PRIZES OR PRIZE WINNER. 

Entrants are restricted to the use of ordinary and typical computer equipment, mobile phone equipment, Internet access and cellular networks. Sponsor, in its sole discretion, reserves the right to disqualify any person tampering with or attempting to tamper with the entry process. 

Sponsor reserves the right to cancel, modify, or terminate the Sweepstakes if fraud, misconduct or technical failure destroys or threatens the integrity of the Sweepstakes, in the opinion of the Sponsor/Administrator, or if a computer virus, bug, or other technical problem or any circumstance, occurrence or event corrupts the administration, security, or proper conduct of the Sweepstakes, or threatens to do so, as determined by Sponsor/Administrator, in their sole discretion. In the event of early termination of the Sweepstakes, Sponsor reserves the right,  to determine the potential winner in a random drawing from among all eligible, non-suspect entries received as of the time/date of such termination. 

This Sweepstakes is not sponsored, endorsed, administered by, or associated with Facebook, Instagram, TikTok or other social media.

In case of disputes: Unless otherwise prohibited by law, as a condition to participating in the Sweepstakes and/or winning a prize awarded by this Sweepstakes, entrant agrees that (1) any and all disputes, claims, and causes of action arising out of or in connection with this Sweepstakes, or any prizes awarded, shall be resolved individually, without resort to any form of class or collective action, and will be determined by final and binding individual dispute resolution under the applicable rules of the American Arbitration Association; (2) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, and in no event will entrant be entitled to receive attorney fees or other legal costs; and (3) other than actual out-of-pocket costs incurred, under no circumstances will entrant be permitted to obtain awards for, and entrant waives all rights to claim, punitive, incidental, and consequential damages, and any other damages and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with this Sweepstakes, shall be governed by and construed by the laws of the State of California, without giving effect to any choice of law or conflict of law rules or provisions (whether of the State of California or any other jurisdiction), that would cause the application of the laws of any jurisdiction other than the State of California. These Official Rules have been drafted with a view to fairness and balance, considering ease of entry, absence of cost to enter, absence of obligation or compulsion to participate, and freedom to choose whether to enter or participate. The provisions of these Official Rules shall be interpreted and construed according to their fair meanings and not strictly for or against any person.
